§ 1 Validity

The customer accepts the following Terms and Conditions of this online antique bookshop Kolonialwelt for all present and future business transactions. 

§ 2 Offer and conclusion of contract

a) While ordering, the customer delivers an offer according to § 145 of the German Civil Code (BGB). He receives our confirmation by e-mail. If there should be a  mistake concerning our online assortment of books, we will inform the customer and submit a new offer. The contract comes about, if we accept the customer's offer in written form or send the ordered product.

b) Our acceptance occurs under the condition that the ordered product is still available. If we can not accept the customer's offer, he will be informed at any rate.

§ 3 Cancellation instruction

You can revoke your contract explanation within one month without giving reasons by letter or by return of the order. For the protection of the cancellation term the timely sending of the cancellation or the order is enough. The cancellation is to be directed to:

§ 4 Terms of payment

The sending of the product occurs against precash or in certain cases on calculation. Deliveries abroad occur always against precash. The forwarding expenses are explained under §5. With calculation the customer undertakes on receipt of the product within 30 days to pay the purchase price. At the end of this term the customer comes to default. The legal delay regulations of Germany are valid. The customer has a right to the compensation only if his counterclaims were ascertained legally or were recognised by us. The exercise of a retention right exists only if the counterclaim is based on the same contractual relationship.

§ 5 Costs

The prices get on in euro. For the dispatch within Germany we calculate the lowest possible amount according to cost table of the German post. For the foreign countries we have provided a forwarding expenses table which is performed under the point "Shipping & Returns".

§ 6 Guarantee and liability

In the online antique bookshop Kolonialwelt books, magazines, etc. are sold, based of their age they will show the use tracks which are considered in the respective retail price already appropriately diminishing. The goods are delivered in this respect exclusively in the implementation given in our topical online catalogue. Turns out that ordered products are not available, we reserve ourselves the resignation of the contract. We will inform the customer immediately about the non-availability and refund any considerations already produced by the customers immediately. In addition, we are entitled in cases by higher power to extend terms of delivery. In this cases we will immediately inform the customer.

§ 7 Clarification

Objects from the time 1933 to 1945, with in it to contained time-historical or military-historical representations and contents, are only sold for purposes of civic clarification, the defence of unconstitutional and anti-constitutional attempts, the scientific and cultural-historical research etc. according to §86 StGB of german law.

§ 8 Retention of title

The product remains a property of Kolonialwelt up to the final payment.

§ 9 Privacy Notice

We collect some necessary data within the scope of the german federal data protection act to be able to carry out the purchase winding up and to be able to maintain our customer management as well as customer relations. We will transmit none of your data to any third party persons. You are entitled at every time to catch up information about the data stored by us and correct the data or to let them extinguish. This technology provides that no unjustified person can coread by the transference of your data.

§ 10 Final regulations

It is worth the right of the Federal Republic of Germany. The regulations of the UN-purchase right find no use. Hildesheim in Germany is the exclusive legal venue for all disputes which may arise from this contract. Should single regulations of the contract with the customer be or become ineffective including these general terms of business, the validity of the remaining regulations is not touched through this. The ineffective part of the regulation should be substituted with a regulation which economic success of the ineffective ones comes close possibly.
